Can We Build It?
Can you actually build this with your time, money, and skills? That's what we're checking.
For AI products, the question isn't "can we code it?" It's "will the AI behave the way we need it to?" Traditional software is deterministic -- the same input always produces the same output. AI is probabilistic -- the same prompt can generate different responses each time. This fundamental difference changes everything about how you assess technical feasibility.
The implications cascade through your entire product design. Deterministic software can be tested with automated test suites that check exact outputs. Probabilistic software requires evaluation frameworks that assess output quality across distributions. Deterministic software's failure modes are predictable -- a bug produces the same wrong answer every time, making it easy to identify and fix. Probabilistic software's failure modes are stochastic -- it might produce a wrong answer 5% of the time, and you won't know which 5% until a user reports it.
This doesn't mean AI products are inherently riskier -- it means they require different risk assessment approaches. The founders who succeed with AI products are the ones who understand this distinction deeply and design their products accordingly. They build guardrails, implement evaluation pipelines, and design user experiences that gracefully handle uncertainty.
AI Isn't Always Predictable
Normal software always gives the same answer. AI doesn't. The same question can get different answers each time.
If you need 100% accuracy (legal, medical, financial), you may need humans to check every answer. That gets expensive fast. A "human-in-the-loop" requirement can add $5-20 per interaction in labor costs. At 1,000 interactions per day, that's $5,000-20,000/month -- which may completely destroy your unit economics if you haven't planned for it.
The key question is: what's the cost of a wrong answer? If a wrong answer is mildly annoying (an imperfect product recommendation), AI autonomy is fine. If a wrong answer is catastrophic (incorrect tax advice, wrong medical dosage), human oversight is non-negotiable, and the cost of that oversight must be baked into your business model from day one.

The Proof of Concept Requirement
For any AI product, a technical proof of concept (POC) is essential before committing to a full build. The POC doesn't need to be pretty -- it needs to answer three questions:
- Can the AI produce outputs of sufficient quality? Build a minimal pipeline with 20-30 representative inputs from your target use case. Evaluate outputs against a quality rubric. If fewer than 80% meet your quality bar, you have a significant technical risk that needs to be addressed before proceeding.
- What does the interaction actually cost? Log every API call, token count, and database query during POC testing. Calculate the real cost per interaction. This number feeds directly into your unit economics.
- How does the system handle edge cases? Test with adversarial inputs, unusual formats, and boundary conditions. AI systems fail most spectacularly on inputs the developer didn't anticipate.
The Smallest Useful Version Test
Define the "Smallest Useful Version" without AI. If the product has zero value without the AI component, your technical risk is existential -- the AI must work perfectly or the business fails.
The best AI products have value even when the AI fails. Notion works as a document editor even without its AI features. Canva works as a design tool even without AI-generated images. Build a product where AI enhances the experience but isn't the only thing holding it together. Can We Deliver It?
The Operational Capability Audit assesses whether your team can actually execute on the plan. This goes beyond technical skill to encompass process maturity, knowledge management, and organizational resilience.
Many startups fail not because the technology doesn't work, but because the team can't operationalize it. They build a brilliant prototype that works on the founder's laptop, but can't turn it into a reliable service that handles thousands of concurrent users with 99.9% uptime. The gap between "it works in demo" and "it works in production at scale" is where operational feasibility lives.

The "Bus Factor" Assessment
The "bus factor" is the number of team members who could be hit by a bus (or quit, or get sick) before the project stalls. A bus factor of 1 means a single departure could paralyze your company. At the feasibility stage, many startups have a bus factor of 1 for nearly every function -- the CTO is the only one who understands the codebase, the CEO is the only one with customer relationships, the designer is the only one who knows the brand guidelines.
You don't need to eliminate this risk entirely at the feasibility stage, but you do need to acknowledge it and have a plan. At minimum, document critical processes, ensure code is well-commented and version-controlled, and make sure customer relationships are tracked in a CRM rather than solely in the founder's inbox. These steps cost almost nothing but dramatically reduce your operational risk.
Is It Legal?
Compliance isn't a "later" problem. In 2026, it can kill your launch if you're not ready. Regulatory risk is especially acute for AI products, fintech, healthtech, and edtech -- but no startup is immune. Even a simple SaaS product handling customer data must comply with privacy regulations in every jurisdiction where it operates.
The founders who treat compliance as a strategic advantage -- rather than an annoying checkbox -- are the ones who win. When your competitor can't enter the EU market because they didn't plan for GDPR, or can't sell to enterprises because they don't have SOC2, your compliance investment becomes a competitive moat.
EU AI Act (2025/2026)
AI in HR, education, or critical infrastructure faces heavy compliance burdens:
- Mandatory logging and transparency -- you must be able to explain how the AI reached its conclusions
- Human oversight requirements -- certain decisions cannot be fully automated
- Conformity assessments -- independent verification that your system meets requirements
- Risk classification -- your AI system must be categorized as minimal, limited, high, or unacceptable risk
Impact: Compliance costs can be tens of thousands of Euros. If you can't afford it, your model isn't viable in the EU. But if you can, you gain access to a 450-million-person market where non-compliant competitors can't operate.
US Regulation
A patchwork of state-level requirements that creates complexity:
- California: CCPA/CPRA with regular updates, AI safety legislation, employee data protections
- Colorado: Strict AI disclosure requirements for high-risk decisions
- Illinois: BIPA (Biometric Information Privacy Act) with severe penalties
- Federal: Executive orders on AI safety, sector-specific guidance from FTC, SEC, HHS
Impact: Model compliance costs for the strictest jurisdiction you'll operate in. The safe strategy is to design for California compliance (the strictest major market) and treat that as your baseline.
Industry-Specific Compliance
Beyond general AI and data privacy regulations, many industries have their own compliance requirements that can significantly impact feasibility:
Fintech
Money transmission licenses ($50K-500K per state), KYC/AML requirements, PCI DSS compliance for payment data, banking partner due diligence. The regulatory overhead can add $200K+ to your first-year costs and 6-12 months to your timeline.
Consider BaaS (Banking as a Service) partners to shortcut some requirements.
Healthtech
HIPAA compliance (mandatory for any health data), FDA clearance for clinical decision support, state medical licensing requirements if providing medical advice. BAAs (Business Associate Agreements) required with all data processors.
HIPAA-compliant infrastructure adds 20-40% to hosting costs.
Edtech
FERPA (student data), COPPA (children under 13), state student privacy laws, district-level procurement requirements. Many school districts require SOC2 Type II reports and specific data handling agreements.
Enterprise sales cycles in education can be 6-18 months due to procurement.
Build Compliance In From the Start
Can your system delete user data on request? Store data in specific countries? Provide an audit trail of AI decisions? If not, fix it before you build. Adding compliance later costs 10x more.
Here's a practical test: write down the five most likely compliance requests you'll receive in your first year (data deletion, data export, consent management, access logging, decision explanation). Can your planned architecture handle all five? If not, redesign now. The architecture decisions you make in the first three months of development will either enable or prevent compliance for the life of the product.
